1. Agreement to Terms
By using the OTP SMS Service (the "Service") provided by TECHWAVE LINKS LIMITED, you agree to these Terms & Conditions. If you do not agree, do not use the Service.
2. Service Description
The Service sends one-time passwords (OTPs) and verification SMS messages to phone numbers you provide. OTPs are intended only for authentication and verification purposes.
3. User Responsibilities
You represent and warrant that: (a) you will only use the Service for lawful purposes; (b) you have the right to send messages to the phone numbers submitted; (c) you will not use the Service to send spam, phishing, harassment, or any unlawful or deceptive messages.
4. Data & Privacy
We collect and process phone numbers and related metadata required to send SMS. Personal data will be processed according to our Privacy Policy. By using the Service you consent to the collection and processing of that data for delivery, fraud prevention, and troubleshooting.
5. OTP Security & Expiry
OTPs expire after the time limit set by you or the Service (commonly 5–15 minutes). You are responsible for how you implement OTP verification and must ensure secure handling of OTPs. We are not responsible for unauthorized access resulting from your insecure implementation.
6. Acceptable Use
Prohibited uses include (but are not limited to): bulk unsolicited marketing messages, illegal content, impersonation, fraudulent activities, sending messages to numbers on national do-not-call lists, and circumventing recipient consent requirements.
7. Rates, Billing & Refunds
Use of the Service may incur fees. Fees, billing cycles, and refund policies are described in your account plan. You are responsible for ensuring funds or credits are available. Failed transactions may result in message delivery failures.
8. Limits & Suspension
We may limit or suspend your access if we detect abuse, suspicious activity, excessive failure rates, or violation of these Terms. We may also impose rate limits to protect platform stability.
9. Warranties & Disclaimers
The Service is provided "as is" and "as available." We do not warrant uninterrupted delivery, message speed, or absolute accuracy. Delivery depends on third-party carrier networks.
10. Liability Limitation
To the fullest extent permitted by law, our liability is limited to direct damages up to the total fees you paid in the 3 months prior to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
11. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses arising from your use of the Service or violation of these Terms.
12. Termination
Either party may terminate access to the Service with notice. Termination does not relieve you of obligations accrued prior to termination, including payment obligations.
13. Changes to Terms
We may update these Terms. We will notify account owners of material changes. Continued use after notice constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of Kenya. Disputes will be resolved in the courts of that jurisdiction unless otherwise agreed in writing.

Restricted Content & Activities
The OTP SMS Service must not be used to support, promote, or distribute any of the following:
- Adult, sexually explicit, or pornographic content;
- Recreational or illegal drugs, drug paraphernalia, or controlled substances;
- Betting, gambling, lotteries, or games of chance;
- Deceptive, fraudulent, or harmful messages of any kind.
Violations may result in immediate suspension or termination of service access without refund.
We reserve the right to report unlawful activity to the appropriate authorities.
